Terms of Service

Article 1 (Operator)
Cosnap (hereinafter referred to as "the Service") is operated by Orbisana Inc. (hereinafter referred to as "the Operator"). All inquiries and communications regarding the Service should be directed to the Operator.
Article 2 (Purpose)
These Terms of Service set forth the conditions for using the Service. By using the Service, users agree to comply with these terms.
Article 3 (Definitions)
- "User" refers to anyone who uses the Service, including Cosplayers and Photographers.
- "Cosplayer" refers to a cosplayer who has applied, been approved by the Operator, and is registered on the Service as available for photoshoots.
- "Photographer" refers to a person who has applied, been approved by the Operator, registered an account on the Service, and submits photoshoot requests to cosplayers.
- "Account" refers to the login credentials and profile information created by a User to access the Service.
Article 3-2 (Account Registration & Management)
To use certain features of the Service, Users must register an account by providing accurate information and completing the Operator's review process. Users agree to the following:
- Users must provide truthful and accurate information during registration.
- Users are responsible for maintaining the confidentiality of their login credentials (email and password).
- Users must not share their account with third parties or allow others to use their account.
- The Operator is not responsible for any damages resulting from unauthorized use of a User's account.
- Users may request account deletion by contacting the Operator.
Article 4 (Prohibited Activities)
Users must not engage in the following activities:
- Any act that violates laws or public order and morals
- Unauthorized direct contact with cosplayers outside of the Service
- Submitting false information during registration
- Unauthorized commercial use of photographs taken during shoots
- Any act that infringes on the privacy of cosplayers
- Any act that interferes with the operation of the Service
- Any act that infringes on the rights of third parties
- Harassment, threats, or intimidation through the chat feature or any other means
- Uploading images that contain illegal content, violate the rights of others, or are unrelated to the Service
- Attempting to circumvent the Service to arrange photoshoots without the Operator's involvement
Article 5 (Photoshoot Requests)
All photoshoot requests must be made through Cosnap. Direct contact with cosplayers is prohibited. The Operator will review requests and facilitate matching when conditions are met. After a match is confirmed, further coordination will be handled through the chat feature provided by the Service.
Article 5-2 (Chat Feature & Monitoring)
The Service provides an in-app chat feature for communication between matched cosplayers and photographers. Users agree to the following conditions when using the chat feature:
- The Operator may review chat messages for the purposes of service operation, safety management, dispute resolution, and responding to reports or support requests.
- Users must not use the chat feature for harassment, solicitation, spam, or any activity that violates these Terms of Service.
- Users may report inappropriate behavior or request support from the Operator through the chat interface. The Operator will review such reports and take appropriate action.
- Chat messages are stored securely and will not be disclosed to third parties except as required by law or for dispute resolution purposes.
Article 5-3 (Profile Photos & Uploaded Images)
Users may upload profile photos, portfolio images, and other content to the Service. By uploading, Users agree to the following:
- Users must only upload images that they have the right to use (images they own or have permission to use).
- Uploaded profile photos and portfolio images will be displayed publicly on the Service to other Users.
- Photographers are recommended to set a profile photo to help cosplayers feel comfortable. Profile photos should be appropriate and clearly represent the User.
- The Operator may remove any uploaded content that violates these terms or is deemed inappropriate.
- The Operator does not claim ownership of uploaded content, but is granted a non-exclusive license to display it on the Service.
Article 5-4 (Translation Feature)
The Service provides an automatic translation feature powered by third-party services (e.g., Google Translate) to assist communication between Users of different languages.
- The Operator does not guarantee the accuracy, completeness, or reliability of translated content.
- Users should not rely solely on automatic translations for critical communications.
- The Operator is not responsible for any misunderstandings, disputes, or damages arising from translation errors.
Article 6 (Images & Copyright)
Copyright of photographs taken during a shoot belongs to the photographer. However, portrait rights belong to the cosplayer. Any use of photos on social media or other platforms must follow the conditions agreed upon in advance. Commercial use requires separate consent from the cosplayer.
Article 7 (Disclaimer)
Cosnap is not directly responsible for disputes between users. Issues arising from photoshoots after matching should, in principle, be resolved between the parties involved. However, the Operator will intervene in cases of serious disputes.
Article 8 (Handling of Personal Information)
Personal information collected from users will only be used for the purpose of operating the Service. It will not be disclosed to third parties except as required by law.
Article 8-2 (Account Suspension & Termination)
The Operator reserves the right to suspend or terminate a User's account without prior notice in the following cases:
- Violation of these Terms of Service or applicable laws
- Receipt of reports from other Users regarding inappropriate behavior
- Submitting false information during registration or use of the Service
- Actions that threaten the safety or well-being of other Users
- Any other conduct deemed inappropriate by the Operator
The Operator is not obligated to disclose the specific reason for suspension or termination. Users whose accounts have been suspended or terminated may not create new accounts without the Operator's permission.
Article 9 (Changes to Terms)
The Operator may modify these terms when deemed necessary. Updated terms will be posted on the Service.
Article 10 (Governing Law & Jurisdiction)
These terms are governed by the laws of Japan. Any disputes related to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
